Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy applies to Functional Balance, Inc. ("we," "us," or "our") and describes how we collect, use, share, and protect "consumer health data" as defined by the Washington My Health My Data Act (RCW 19.373). It applies to Washington State residents and to any consumer whose consumer health data we process.

This policy addresses only consumer health data under the My Health My Data Act. Our general handling of other personal information is described in our separate Privacy Policy.

1. Categories of Consumer Health Data We Collect, and Why

We collect consumer health data only when you voluntarily choose to provide it in a survey. You are never required to provide it to purchase or use our products or services.

The categories of consumer health data we may collect are:

  • Information about your physical health, symptoms, or bodily condition that you choose to share
  • Information about your mental or emotional health, including stress and experiences related to trauma
  • Your name and email address, where you choose to attach them to the responses above

Purpose and use. We collect this information solely to understand our students' experiences, to measure the results and effectiveness of our programs, and to improve what we offer. We do not use consumer health data for advertising, and we do not use it to make decisions that produce legal or similarly significant effects about you.

2. Sources of Consumer Health Data

We collect consumer health data from a single source: directly from you, through survey responses you voluntarily submit. We do not collect consumer health data from data brokers, public sources, social media, or any other outside source.

3. Categories of Consumer Health Data We Share

We share consumer health data only with the service providers that host our surveys and store responses on our behalf, and only so that we can operate our Services. These providers process the data under our instructions and are contractually restricted from using it for their own purposes.

The categories of third parties with whom we share consumer health data are:

  • Survey and data-storage service providers — the platform(s) we use to collect survey responses and store them: Thinkific, Tally.so, Google Forms, Google Drive, ActiveCampaign.

Affiliates. We do not share consumer health data with any affiliates. We have no corporate affiliates.

We do not sell consumer health data. We do not sell your consumer health data, and we do not share it for advertising or for any purpose beyond those described in this policy.

4. Your Rights

If you are a Washington resident, or otherwise protected under the My Health My Data Act, you have the right to:

  • Confirm and access — confirm whether we are collecting, sharing, or selling your consumer health data, and access that data, including a list of all third parties and affiliates with whom we have shared it.
  • Withdraw consent — withdraw your consent to our collection and sharing of your consumer health data at any time.
  • Delete — request that we delete your consumer health data. When you make this request, we will delete the data from our records and notify the service providers with whom we have shared it to delete it as well.
  • Appeal — if we decline your request, you may appeal by replying to our decision. If your appeal is denied, you may contact the Washington State Attorney General at www.atg.wa.gov/file-complaint.

How to exercise your rights. Email us at info@sukiebaxter.com with your request. We will respond within 45 days. If we need more time, we may extend this period by an additional 45 days and will let you know. We will not discriminate against you for exercising any of these rights.

5. How We Obtain Consent

We obtain your clear, affirmative, opt-in consent before collecting your consumer health data, at the point where you choose to provide it. We obtain separate consent before sharing it beyond the service providers described above. Consent is never a condition of purchasing or using our Services.
